Introduction to JCT Standard Building Contract 2016 - 4. Summary of the Schedules

The schedules are located at the back of the contract and consist of the following:

  • Schedule 1 – Design Submission Procedure. This is to be used if you have a design portion as part of the contract. This is the design submission procedure to allow the contractor to submit designs.

  • Schedule 2 – Variations and Acceleration Quotation Procedures

  • Schedule 3 – Insurance Options

  • Schedule 4 – Code of Practice (for opening up of works)

  • Schedule 5 – Third Party Rights. You can include third-party people to be included as part of the contract. They could have all rights or partial rights and responsibilities of the contract.

  • Schedule 6 – Forms of Bonds Advance Payment Bond Off-Site Materials Bond

Retention Bond. For instance, if the employer made an advance payment they would want protection via an advance payment bond. If the employer paid for materials off-site again they would need some security in the form of a bond. Retention bonds are used in the absence of a percentage deducted from the contract sum for retention.

  • Schedule 7 – JCT Fluctuations Option A only. This deals with any major fluctuation in costs after the contact base date, to say Government changes to tax or legislation. The contractor would, therefore, have the right to recover that extra cost. This schedule does not deal with general fluctuations. For general fluctuations, to include this you have to do this manually into the contract. If this is not done then general fluctuations such as price increase in materials is not included as remains the risk of the contractor.

  • Schedule 8 – Supplementary Provisions. There are various supplementary provisions you can add to the contract that cater for various clauses throughout the contract. Such as negotiations and disputes.

The schedule may or may not be used as part of the contract. It is entirely up to the parties to decide if they wish to use the schedules.
